Purpose The purpose of this paper is to offer some reflection on the abuse of consumer trust and the importance of control of information in the digital market and the green market. The role of the consumer as the arbiter of the market is fundamental. The abuse of consumer confidence depends, in fact, on the spread of stereotyped messages and vague and generic formulas aimed at hiding a dangerous vacuum of protection. The Substitutability of Unfair Contract Terms in Credit Agreements Denominated and Indexed to Foreign Currencies

This contribution deals with the problem of the capacity of the court to replace the unfair term in the loan agreements with a supplementary provision of national law. The main aim of the contribution is to confirm the thesis, that the court is not entitled to change the condition for which it states that it is unfair despite the conscious and fixed will of the consumer himself.
